We let commercial units, studios and rooms, and we provide property services including refurbishment, repairs and maintenance, removals, clearance and end of tenancy servicing. We are the data controller for the personal information described in this policy, which means we decide how and why it is used.
Registered office: 14/2e Docklands Business Centre, 10-16 Tiller Road, London E14 8PX.
Email: enquiries@ariealtd.com. Telephone: 020 7646 3441.
We follow the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations.
2. What we collect
- Contact details: your name, email address, phone number and address.
- Enquiry details: what you are looking for, such as a unit, a room or a service, the property concerned, your message, and any photos or documents you choose to send.
- Tenancy and letting information: if you rent from us or apply to, the details needed to arrange and manage the letting, such as identification and right to rent checks, references, payment records, deposit and inventory information, and records of repairs and communications.
- Business information: for commercial customers, your company name, number, trading details, and the contact details of directors or authorised people.
- Service and job information: access arrangements, property condition, quotes, invoices and records of work we carry out for you.
- Technical information: your IP address, browser type, device and the pages you visit, collected through cookies and similar technologies if you allow them, and through standard server logs.
- Communications: emails, messages, calls and social media messages between you and us.
Please do not include sensitive information, such as health details, in the enquiry form unless it is necessary for your enquiry. If you choose to tell us something like this, for example because you need an accessible room, we will use it only for that purpose.
3. How we collect it
We collect information directly from you through the website forms, email, phone, messaging apps, viewings and our written agreements. We also receive information from referencing and credit reference agencies, right to rent and identity checking services, previous landlords and employers where you have given us their details, listing sites such as SpareRoom, and public sources such as Companies House and the Land Registry. Our website collects technical data automatically.
4. Why we use it and our legal bases
| What we do | Legal basis |
|---|---|
| Reply to your enquiry, arrange viewings and provide quotes | Taking steps at your request before entering into a contract; legitimate interests |
| Set up, manage and end a tenancy or licence, and carry out work you have agreed | Performing a contract |
| Carry out right to rent, identity and anti-fraud checks, keep records for tax and accounting | Legal obligation |
| Run, secure and improve our business and website, prevent fraud, and deal with disputes and claims | Legitimate interests |
| Send marketing messages and set optional cookies | Your consent, which you can withdraw at any time |
Where we rely on legitimate interests, we have considered the effect on you and only go ahead where our interests are not outweighed by your rights.
5. Who we share it with
We do not sell your personal information. We share it only where needed, with:
- service providers that act on our instructions, including website hosting, email delivery, a system for recording and answering enquiries (including a spreadsheet and a messaging platform), and IT support;
- referencing, credit reference, identity and right to rent checking providers, when you apply to rent;
- contractors, tradespeople and removal teams who carry out work at your property or for you, limited to what they need;
- insurers, deposit protection schemes, accountants, solicitors and other professional advisers;
- local authorities, the police, HM Revenue and Customs and other authorities where the law requires or permits it;
- another business, if we sell or reorganise our business, which would be bound to protect your information in the same way.
Where a provider processes data for us, we have a contract requiring it to keep your information secure and to use it only on our instructions.
6. Transfers outside the UK
Some of our providers may store or process information outside the UK. Where this happens we make sure a lawful safeguard is in place, such as the destination country being recognised by the UK as providing adequate protection, or approved standard contractual clauses.
7. How long we keep it
We keep information only for as long as we need it for the purposes above.
- Enquiries that do not lead to a letting or a job: up to 12 months.
- Tenancy, licence and job records, invoices and payment records: for the length of the relationship and up to six years afterwards, to meet tax, accounting and limitation rules.
- Right to rent documents: for the length of the tenancy and one year afterwards, as the law requires.
- Marketing details: until you withdraw consent or ask us to stop.
- Cookie data: as set out in our Cookie Policy.
After this we delete or anonymise the information.
8. How we keep it safe
We use sensible technical and organisational measures to protect your information, including secure hosting, access limited to people who need it, and checks on the providers we use. No online service is completely secure, so please take care with what you send. If a breach is likely to put your rights at risk, we will tell you and the Information Commissioner's Office as the law requires.
9. Marketing
We will send you news or offers by email or text only if you have asked us to or agreed to it. You can stop at any time by using the unsubscribe link, replying to the message or emailing enquiries@ariealtd.com. Opting out of marketing does not stop messages we need to send you about your enquiry, tenancy or work.
10. Cookies
Our website uses necessary cookies, and optional cookies only if you agree. Please read our Cookie Policy, where you can also change your choices.
11. Your rights
Under UK data protection law you have the right to:
- be told how your information is used, and to see a copy of what we hold;
- have inaccurate information corrected;
- have your information erased, in some circumstances;
- restrict how we use it, in some circumstances;
- object to our use of it where we rely on legitimate interests, and at any time to direct marketing;
- receive the information you gave us in a portable format;
- withdraw consent at any time, where we rely on it, without affecting what we did before;
- not be subject to a decision made only by automated means that significantly affects you. We do not make decisions of this kind.
To use any of these rights, email enquiries@ariealtd.com. We may need to confirm who you are first, and we will normally reply within one month. There is no fee unless a request is clearly unreasonable.
12. Complaints
Please tell us first if you have a concern, so we can put it right. You also have the right to complain to the Information Commissioner's Office at ico.org.uk, or on 0303 123 1113.
13. Changes to this policy
We may update this policy from time to time. The current version is always on this page, with the date it was last updated at the top.
